Terms of Service

Last updated: 16 August 2026 · Operator: Fvawi Drein INC · Governing law: State of Colorado, USA

1. Who we are

These Terms of Service (the "Terms") are a binding agreement between you and Fvawi Drein INC, a company registered in the United States with its registered address at 1942 Broadway Ste 314C, Boulder, CO 80302, United States ("OriginCoder", "we", "us"). They govern your access to and use of the OriginCoder API gateway, dashboard and related documentation (together, the "Service"), available at origincoder.com.

By creating an account, purchasing a plan or sending a request to our API, you confirm that you have read, understood and agreed to these Terms, our Privacy Policy and our Acceptable Use Policy.

2. What the Service is

OriginCoder is an API gateway. We provide a single OpenAI-compatible endpoint that forwards your requests to third-party large language model providers and returns their responses to you, together with account management, usage records and consolidated billing.

  • We do not train, host or own the underlying models. Model outputs are generated by the third-party provider you select through the model parameter.
  • We are an independent platform. We are not affiliated with, endorsed by or sponsored by Anthropic, OpenAI, Google, Meta or any other model provider. All trademarks belong to their respective owners.
  • Model availability, capabilities, context limits and pricing are determined by the upstream provider and may change without notice.

3. Accounts and eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and legally able to enter into contracts. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

  • You are responsible for all activity under your account and for keeping your API keys confidential. Treat an API key like a password; anyone holding it can spend your balance.
  • Notify us immediately at support@origincoder.com if you believe a key has been exposed. You can revoke and reissue keys at any time from the dashboard.
  • One person or organisation may not operate multiple accounts to circumvent rate limits, free-tier allowances or a suspension.

Restricted jurisdictions. We do not provide the Service to users located in countries or territories subject to comprehensive US sanctions, or to any person on a US restricted-party list. The current list is set out in Countries and Regions.

4. Plans, credits and rate limits

Access is sold as monthly subscription plans and as prepaid balance. Each plan grants a monthly credit allowance and a request-rate ceiling, both published on the pricing page before purchase.

  • Credits are consumed by the tokens your requests actually use. Different models consume credits at different rates; the current rate for each model is shown on the pricing page.
  • Credits reset at the start of each billing period and do not roll over unless the plan description states otherwise.
  • Requests above your allowance are declined with an error. We do not silently charge you for overage.
  • Rate limits are expressed in requests per minute and are enforced per account.
  • Every API call is recorded with its model, token counts and cost, and can be exported for reconciliation.

5. Payment methods and billing

All prices are published and charged in US dollars (USD) and are exclusive of any taxes, duties or levies that may apply in your jurisdiction. You are responsible for such taxes unless we are required to collect them.

| Method | How it works | |---|---| | Card, via Stripe | Visa, Mastercard, American Express and other card networks supported by Stripe. Payments are processed by Stripe, Inc.; we never receive or store your full card number. Subscriptions renew automatically on the same day each month until cancelled. Your card statement will show a descriptor identifying OriginCoder. | | USDT on TRC20 | We accept USDT on the TRC20 (Tron) network only. Sending USDT on any other network — ERC20, BEP20, Polygon or otherwise — will result in permanent loss of funds that we cannot recover. Crypto payments are one-time and non-recurring: you send an amount, we credit your balance after on-chain confirmation. Because blockchain transfers are irreversible, confirmed USDT payments are final and non-refundable. Network fees are borne by the sender. |

An invoice or receipt is issued for every successful payment and is available in your dashboard.

If a card payment fails, we may retry it and may suspend access until payment succeeds. Repeated failures may result in cancellation of the subscription.

6. Cancellation and refunds

You may cancel a subscription at any time from your dashboard. Cancellation stops the next renewal; your plan remains active until the end of the period you have already paid for. We do not pro-rate partial months.

  • First purchase. If the Service does not work for you, you may request a full refund within 7 days of your first card payment, provided you have consumed less than 10% of that period's credit allowance.
  • Renewals are generally non-refundable. If you were charged in error, or the Service was materially unavailable for an extended period, contact us and we will review the case.
  • USDT top-ups are non-refundable once confirmed on-chain, for the reasons described above.
  • Approved card refunds are returned to the original payment method through Stripe, normally within 5–10 business days depending on your bank.

Full details are in Refund and Cancellation Policy. To request a refund, email support@origincoder.com from the address registered to your account, stating the invoice number and the reason.

7. Acceptable use

You must comply with our Acceptable Use Policy and with the usage policies of the upstream provider serving your request. In summary, you may not use the Service to generate or distribute unlawful content, to attempt to breach the security of any system, to resell raw model access in a way that conceals the upstream provider's terms, or to circumvent rate limits or geographic restrictions.

8. Third-party model providers

When you send a request, its contents are transmitted to the upstream provider you selected so that provider can generate a response. That provider processes the data under its own terms and privacy policy. We recommend reviewing the policies of any provider you rely on.

We are not responsible for the content, accuracy, legality or fitness for purpose of model outputs. Outputs may be inaccurate, offensive or misleading; you are responsible for reviewing them before relying on them, and for any decision you make based on them.

9. Availability and support

We aim for high availability and operate automatic failover across multiple upstream providers, but the Service is provided on an "as available" basis. Any uptime figure published on our website is a target, not a contractual service-level guarantee, unless we have signed a separate agreement with you that says otherwise.

Support is provided by email at support@origincoder.com and through our Telegram and Discord channels, with a target first response within one business day.

10. Warranties and liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the three (3) months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, or for death or personal injury caused by negligence.

11. Changes, suspension and termination

We may update these Terms. If a change materially reduces your rights, we will give notice by email or in the dashboard at least 14 days before it takes effect. Continuing to use the Service after that date constitutes acceptance.

We may suspend or terminate your account immediately if you breach these Terms or the Acceptable Use Policy, if required by law or by an upstream provider, or if your account is used in a way that threatens the security or stability of the Service. Where we suspend an account for a first, non-severe breach, we will normally contact you first.

On termination by us for reasons other than your breach, unused paid credits are refunded on a pro-rata basis.

12. Contact and disputes

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Colorado, except that either party may seek injunctive relief in any competent court to protect its intellectual property or confidential information.
